TERMS OF SERVICE

Welcome to Evidence, an application designed to facilitate the tracking and capture of personnel forms in the field. By using Evidence, you agree to these Terms of Service, so please read them carefully.
1. DESCRIPTION OF SERVICE
Evidence is a mobile application that enables organizations to efficiently manage field personnel through:
- Real-time geolocation.
- Assignment and tracking of tasks.
- Digital capture of forms with multimedia evidence.
- Registration of activity and fulfillment of operational objectives.
2. ACEPTANCE OF TERMS
By accessing and using Evidence, you agree to these terms and acknowledge that:
- You have authorization from your organization to use the application.
- You understand that the use of geolocation and data capture is subject to your company’s internal policies.

3. RESPONSIBLE USE
You agree to use Evidence only for work purposes authorized by your company, and will refrain from:
- Manipulating captured data or reporting false information.
- Share your access credentials with third parties.
- Interfering with the operation of the application or attempting to breach its security.
4. GEOLOCATION AND PERSONAL DATA
Evidence uses background location services to ensure the traceability of personnel in the field. The use of this functionality implies the explicit consent of the user and/or his/her employer, in accordance with the data protection laws in force.
The forms, photographs, signatures and other data captured are the property of the company contracting the service and are securely stored on authorized servers.
5. SERVICE AVAILABILITY
Evidence strives to ensure continuous service availability, but cannot ensure uninterrupted operation due to external factors such as device connectivity, scheduled maintenance or unforeseen failures.
6. INTELLECTUAL PROPERTY
All intellectual property rights to the application, its design, functionalities and content belong to Softelligence S.A. de C.V. Any reproduction, distribution or modification without prior written authorization is prohibited.
7. MODIFICATIONS / UPDATES
The Company reserves the right to update these Terms of Service at any time. Users will be notified of significant changes through the same application or through official channels.
8. TERMS OF CANCELLATION OR TERMINATION OF SERVICE
Access to Evidence’s service may be terminated or suspended in any of the following cases:
- At the request of the contracting company, for administrative or strategic reasons.
- In case of breach of these Terms of Service by the user.
- Termination of the contract between the developer and the contracting organization.
- At the request of the contracting company, for administrative or strategic reasons.
Once the service is cancelled, access to the application will be revoked and the stored data will continue to be accessible only by the contracting company for the period established in its contract. Subsequently, they will be deleted in accordance with the applicable data retention policies.
The user will not be able to demand the continuity of the service on an individual basis, since the ownership of the access corresponds to the contracting organization.
